CLEARPORT

Terms of Service

Home internet: version 1.2, in effect from 25 August 2026 · Roam app and Trip Pass: version 1.1, from 17 October 2026
The Home internet Terms govern agreements entered into from 25 August 2026. A customer who signed an earlier version keeps the version they signed — that is the executed text, and this page does not change it. The Roam app and Trip Pass terms apply to Roam accounts from 7 October 2026.

Clearport — Terms of Service

Version 1.1 — 13 August 2026

---

Plain-language summary up top, because that's the kind of service this is: we install and manage a home network for you — a managed router, secure connectivity, cellular failover, and 24/7 monitoring with real human support. You pay a one-time setup fee and a monthly subscription. Use it lawfully, don't resell it, and we'll keep it running. If something ever goes wrong on either side, this document says we have to tell you what and why, and you always get a chance to respond. The legally binding text is below.

---

1. Who's who

These Terms are an agreement between you (the customer named on the signature page) and Clearport (the "Operator").

The Operator is Clearport Technologies Limited, a company incorporated in Hong Kong (company number 81070373). Assignment clause: the Operator may assign this agreement to a successor entity that continues the Service on the same terms; you'll be notified at least 30 days in advance, and nothing else about your pricing or service changes.

"Service" means the managed home-network service described in Section 2. "Equipment" means the hardware we supply and configure (router, and where applicable a cellular modem and mesh nodes). "Household" means the people who ordinarily live at the installation address, plus their personal guests.

2. What the Service is

Clearport provides, for a single household at a single address:

  1. A managed home network — we supply, configure, install, and maintain the Equipment that runs your home Wi-Fi. The Clearport network becomes your home's Wi-Fi; whole-home coverage can be extended with additional mesh access points where a larger home needs it (Section 5.6).
  2. Secure connectivity — your network traffic is carried over managed, encrypted infrastructure operated by Clearport.
  3. Cellular failover (Plus and Dedicated plans, or as an add-on) — automatic fallback to a mobile-data connection when your broadband fails.
  4. Monitoring and support — 24/7 automated health monitoring of your network, a customer dashboard, and human support over WeChat.

The Service is best-effort, not guaranteed. It depends on third parties we do not control — your broadband ISP, mobile carriers, upstream network and hosting providers, and the public internet itself. We work on reasonable efforts to keep everything running and we monitor it around the clock, but we do not warrant specific speeds, latency, or uninterrupted availability, and we do not offer a formal SLA. (What we do promise: when something breaks, we usually know before you do, and we tell you what's happening.)

3. Acceptable use

You agree to use the Service lawfully. In particular:

  1. Compliance with law. You are solely responsible for your use of the Service and for the activity of your Household on it, and for ensuring that use complies with all laws and regulations applicable to you.
  2. No harm to the network or others. Don't use the Service in any manner that diminishes, disrupts, or threatens the security, reliability, or stability of the Service, our infrastructure, or other customers' service.
  3. No abuse. No sending of spam or unsolicited bulk messages; no attempts to gain unauthorized access to any system or network; no distribution of malware; no network attacks of any kind.
  4. No bulk P2P / no server hosting on shared plans. Capacity on shared infrastructure is provisioned for normal household use (streaming, calls, work, gaming). Torrenting / P2P file-sharing (including seeding) and hosting servers for third parties are not permitted on Standard or Plus plans — they saturate shared capacity and degrade other customers, and P2P traffic carries outsized legal exposure for everyone on shared infrastructure. If your use case genuinely needs this, talk to us about the Dedicated plan, where your capacity (and your exposure) is your own.
  5. Respectful conduct. Support is provided by humans. Abusive, threatening, or harassing conduct toward support staff, or knowingly providing false information in a support or enforcement matter, is itself a violation of these Terms.

Important context for this section: as described in Section 6, we monitor network telemetry, not content. We cannot see — and do not look at — what you do online. That is exactly why responsibility for the lawfulness of your use rests with you and not with us.

4. One household, no resale

The Service is sold to one household at one address. You may not:

Moving home? Tell us — relocating the Service to your new address is a normal support request (a re-install fee may apply depending on distance and complexity).

5. Equipment, credentials, and access

  1. You own the Equipment. The one-time setup fee covers the hardware, delivery, installation, configuration, and handover. After the trial-period keep-or-return window (Section 8), the Equipment is yours.
  2. We manage it. While you subscribe, we maintain remote management access to the Equipment to deliver the Service — monitoring, updates, fixes, and config changes. This access is part of the product; if you revoke or block it, we cannot deliver the managed service and Section 9 (termination) may apply.
  3. Your credentials. Some installations and upgrades (e.g., whole-home/bridge mode) involve you voluntarily sharing ISP account credentials with us. We store these in your private customer record only — never in shared documents — we use them only for the agreed work, and we delete them when you leave the Service.
  4. Your SIM stays yours. Where cellular failover uses a SIM, the mobile-data contract is between you and the carrier, in your name, from day one. We may help you choose and set up a SIM, but we never hold the contract and never resell mobile data. Keeping the SIM topped up is your responsibility; failover only works if the SIM works.
  5. On termination, we remove our remote access and management keys. At your request we will reset the Equipment to standard factory firmware so you can use it as an ordinary router.
  6. Coverage extension. Where a larger home needs more reach, coverage can be extended with AiMesh nodes. Adding mesh coverage never changes your monthly subscription. Mesh hardware is supplied by you or by us at cost; setup is included at no charge for Founding-cohort members (a one-time setup fee may apply for later cohorts).

6. Monitoring and privacy

This section is a promise, not just a disclosure.

What we collect: network telemetry needed to operate and support the Service — link status and uptime, connection quality and throughput, connected-device presence (MAC/IP/hostname), signal strength, Equipment health (CPU, memory, temperature), and event logs from our own infrastructure.

What we don't collect: the content of your traffic. Modern connections are end-to-end encrypted; the content of what you read, watch, send, and say is unintelligible to us, and we do not attempt to inspect it. We have no content-inspection capability built into the Service.

Diagnostic logs on your Equipment: like any home router, your Equipment keeps a short-lived local diagnostic log of DNS lookups — the domain names your devices ask for. This log lives in volatile memory on the device in your home: it is cleared on every reboot and is not routinely transmitted to us. During an active support or diagnostic session we may examine it to diagnose network faults; we do not retain it afterward and do not use it for any other purpose. Our automated health checks also store DNS-health verdicts (a clean/degraded flag — not lists of domains) in our monitoring database.

What we do with telemetry: operate, troubleshoot, and improve the Service, and support you. Nothing else. We never sell or share your data with third parties, except where a valid legal obligation compels us — in which case we disclose the minimum required, and (unless legally prohibited) we tell you.

Retention: operational telemetry is retained on a rolling basis (typically days-to-weeks) and then discarded. Billing and account records are kept as long as required for accounting. Your credentials (Section 5.3) are deleted on termination.

7. Fees and billing

Current pricing, plan tiers, cohort price-locks, billing cadences (monthly / quarterly / yearly), and the referral program are published at clearport.io/pricing.html, which is the canonical commercial schedule and is incorporated into these Terms. In brief, at signing:

Price locks are honored as written — e.g., Founding-cohort lifetime locks survive for as long as your subscription is continuous. Non-payment: if a renewal isn't paid, we'll remind you; if it remains unpaid 14 days after the period starts, we may suspend the Service until paid. Suspension for non-payment doesn't require the Section 10 process — but reinstatement is immediate on payment, no penalty, and your cohort lock survives a suspension (though not a cancellation, per the published cohort rules).

8. Trial period and returns

The first 30 days are a trial at the published trial rate. At the end of the trial, you keep the Equipment and continue at your plan rate — or you may return the Equipment within 14 days, in good condition, for a refund of your setup fee minus the published install/restocking deduction. Exact figures per tier are on the pricing page. (This is a partial-refund mechanic, not a "free trial" — the trial month itself is not refunded.)

9. Cancellation, termination, and refunds

You can leave whenever you want. Cancel any time via WeChat — no forms, no retention scripts, no penalty:

If we terminate or suspend you (only via the Section 10 process, or non-payment per Section 7):

If the Service is discontinued or becomes impossible (Section 12), all unused prepaid fees are refunded pro-rata, always.

10. Enforcement — the fair-process commitment

We hold ourselves to a fair-process commitment in enforcement. This section binds us as much as you:

  1. Notice first. If we believe you have violated these Terms, we will send you a written notice (WeChat or email) that states: (a) the specific term we believe was violated, (b) what we observed that led us to that belief, in as much detail as we can lawfully share, and (c) what would resolve it.
  2. You get to respond. You have 7 days to respond, explain, or cure. We will engage with your response in good faith — including the possibility that we are simply wrong.
  3. Escalation is graduated. Only if the issue is unresolved after that: temporary suspension → and only then, termination (with Section 9's refund rules).
  4. Immediate-action carve-out. We may suspend first and notify within 24 hours only when: (a) we are subject to a binding legal demand; (b) there is active, ongoing harm to the Service, our infrastructure, or other customers; or (c) there is clear evidence of fraud. Even then, steps 1–2 follow immediately — suspension under this carve-out is never silently converted into termination.
  5. No mystery enforcement, ever. We will never terminate your service while refusing to tell you which term was violated and what we observed. If legal obligations prevent us from disclosing the specific reason, we will tell you that we are subject to such a constraint, to the extent we are permitted to do so.

11. Warranties and liability

The Service is provided "as is" and "as available." We disclaim implied warranties (merchantability, fitness for a particular purpose) to the maximum extent permitted by law — but we affirmatively warrant that the Service will materially conform to what Section 2 and our published materials describe, and that we will perform support with reasonable skill and care.

To the maximum extent permitted by law: we are not liable for indirect, incidental, special, or consequential damages (including lost profits, lost data, or substitute services), and our total aggregate liability under these Terms is capped at the fees you paid us in the 12 months preceding the claim. Some jurisdictions don't allow certain limitations; where that's you, those limitations apply only to the extent permitted.

Nothing in these Terms limits liability that cannot lawfully be limited.

12. Events beyond our control (force majeure)

We are not in breach, and not liable, for failure or degradation of the Service caused by events beyond our reasonable control, including: failures or service changes of broadband ISPs, mobile carriers, hosting or upstream network providers; telecommunications or utility failures; denial-of-service or other attacks; government action, regulatory or legal changes; natural disasters; war or civil disturbance.

If such an event interrupts the Service, we'll communicate what we know and work to restore service or provide a workaround. If an event permanently prevents us from providing the Service, either party may terminate, and we refund all unused prepaid fees pro-rata (Section 9).

13. Continuity commitment

We answer the "what if you disappear?" question in writing:

If Clearport ever winds down the Service, we commit to at least 60 days' written notice, a pro-rata refund of all unused prepaid fees, and — on request — a final visit or guided handover that resets your Equipment to standard factory firmware so your home network keeps working without us.

14. Changes to these Terms

We may update these Terms as the Service evolves. Material changes get at least 30 days' notice via WeChat before taking effect, and a summary of what changed. If you don't accept a material change, you may cancel under Section 9 before it takes effect — with a pro-rata refund of unused prepaid fees in that case, since we changed the deal, not you. Continued use after the effective date is acceptance. The current version always lives at clearport.io/terms.html with a visible "last updated" date and a change log.

15. Governing law and disputes

Talk to us first — almost everything is resolved in a WeChat thread within a day. Formally: these Terms are governed by the laws of the Hong Kong Special Administrative Region, and disputes not resolved informally are submitted to the non-exclusive jurisdiction of the courts of Hong Kong.

These Terms are written in English. If a Chinese translation is provided for convenience, the English text governs in the event of any conflict.

16. Entire agreement

These Terms, plus the pricing page they incorporate (Section 7) and your signed signature page, are the entire agreement. If any provision is unenforceable, the rest survives. No failure to enforce a term waives it.

Roam app and Trip Pass terms

Version 1.1, in effect from 17 October 2026 for accounts opened from that date, and from 16 November 2026 for accounts opened earlier (version 1.0 applies to them until then). These terms cover the Clearport Roam app plans (Solo, Family, Unlimited) and the Trip Pass. The Home internet terms above cover the Clearport router service. By signing up for Roam or using it, you accept these terms.

R1. Who's who

The Operator is Clearport Technologies Limited, a company incorporated in Hong Kong (company number 81070373). "Roam" means the Clearport Roam app and the connection service it uses. "You" means the person who signed up.

R2. What Roam is

Roam is an app for your phone, tablet or computer that carries your device's connection over managed, encrypted infrastructure operated by Clearport, so that the international apps and sites you rely on keep working and local sites stay fast.

Roam is best-effort, not guaranteed. It depends on networks we do not control: the Wi-Fi or mobile network you are on, carriers, hosting providers and the public internet. Some networks (hotels, offices, some carriers at busy times) may slow it or stop it. We work to keep it running and we tell you when we know something is wrong, but we do not promise particular speeds or uninterrupted availability, and there is no formal service level.

R3. Your account and your link

R4. Acceptable use

You agree to use Roam lawfully, and you are responsible for your use of it. In particular:

  1. Compliance with law. Make sure your use complies with the laws that apply to you.
  2. No harm to the service or others. Do not use Roam in a way that disrupts or threatens the security or reliability of our infrastructure or other customers' service.
  3. No infringement. Do not use Roam to infringe other people's copyright or other rights, for example by downloading or distributing pirated films, music, software or books. Repeated or serious infringement is a breach we act on under R7.
  4. No abuse. No spam or unsolicited bulk messages, no attempts to gain unauthorized access to any system, no malware, no network attacks.
  5. No bulk file-sharing or server hosting. Roam runs on shared capacity. Torrenting and other peer-to-peer file-sharing (including seeding), and hosting servers for others, are not allowed.
  6. Respectful conduct. Support is provided by people. Abusive or threatening conduct toward them is itself a breach of these terms.

We see connection-health information, not content: we cannot see what you do over Roam (see the Privacy page, clearport.io/privacy). That is why responsibility for the lawfulness of your use rests with you.

R5. Free period, payment and renewal

R6. Refunds

Your first payment is covered by our refund promise: a full refund within 14 days of the first payment of a Roam plan, and within 3 days of paying for a Trip Pass. The details are on the Refunds page, clearport.io/refunds, and they form part of these terms.

R7. Enforcement: the fair-process commitment

If we believe you have broken these terms, we follow the same process as Section 10 of the Home internet terms above: a written notice that names the term, says what we observed and what would resolve it; 7 days for you to respond; and only then suspension, and only after that, termination. We may suspend first and notify within 24 hours only for a binding legal demand, active harm to the service or other customers, or clear evidence of fraud. We will never end your service without telling you which term was broken and what we observed, unless the law forbids it, and then we tell you that it does. If we end your service and it was not for fraud, unlawful conduct or deliberate harm, we refund your unused prepaid fees pro-rata.

R8. Warranties and liability

Roam is provided "as is" and "as available." We disclaim implied warranties to the maximum extent permitted by law, but we do warrant that Roam will materially match what these terms and our published materials describe, and that we will provide support with reasonable skill and care.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, and our total liability under these terms is capped at the fees you paid us for Roam in the 12 months before the claim. Nothing in these terms limits liability that cannot lawfully be limited.

R9. Events beyond our control

We are not in breach when Roam fails or degrades because of events beyond our reasonable control, including failures or changes at carriers, network or hosting providers, attacks on our infrastructure, government action or changes in law or regulation, natural disasters, war or civil disturbance. We will tell you what we know and work to restore service. If such an event permanently prevents us from providing Roam, we refund all unused prepaid fees pro-rata.

R10. If we stop offering Roam

If Clearport ever winds Roam down, we will give you at least 30 days' notice through the contact you signed up with, and refund all unused prepaid fees pro-rata.

R11. Changes to these terms

We may update these terms as Roam evolves. Material changes get at least 30 days' notice through the contact you signed up with. If you do not accept a material change, you may stop before it takes effect and we refund your unused prepaid fees pro-rata. The current version is always at clearport.io/terms.

R12. Law and disputes

Talk to us first; almost everything is resolved in a message. Formally, these terms are governed by the laws of the Hong Kong Special Administrative Region, and disputes not resolved informally go to the non-exclusive jurisdiction of the courts of Hong Kong. These terms are written in English; if a translation is provided, the English text governs.
